Terms of Use

These Terms of Use ("Terms") govern your use of the GymKin mobile app (the "App"), provided by GymKin, Inc. ("GymKin"). By creating an account or using the App you agree to these Terms. If you do not agree, do not use the App.
1. What GymKin is (and is not)
GymKin is a workout-tracking app that can pair with the GymKin Bluetooth motion sensor to count repetitions and estimate technique metrics automatically. Rep counts and derived stats (pace, range of motion, power, estimated one-rep max, and similar) are estimates produced by sensors and algorithms. They can be wrong. The App asks you to review and confirm counts, and you can always correct them.
GymKin is not a medical device and provides no medical advice. Consult a qualified professional before starting an exercise program. You are responsible for training safely, using equipment correctly, and choosing weights appropriate for you. Do not rely on the App's numbers for decisions that could affect your safety.
2. Your account
You must provide accurate information, keep your credentials secure, and be at least 13 years old. To contribute recordings you must be 18 or older. You are responsible for activity under your account. You can delete your account at any time in Profile → Privacy & account → Delete account…; deletion is permanent.
3. The sensor
The GymKin sensor is sold separately at gymkin.com/shop. Hardware warranty and returns are governed by the terms at the point of sale, not by these Terms. The App works without the sensor (manual and video logging).
4. Your content
You keep ownership of the content you create in the App (workout data, profile, anything you share). You grant us the limited license needed to store and display it back to you — and, if you use social features, to show what you share to the friends you share it with. Don't post content that is unlawful, infringing, or abusive; we may remove such content and suspend accounts that violate this.
5. Acceptable use
Don't: reverse engineer or disrupt the App or its services; access other users' data; automate access to our backend; use the App where distraction would be unsafe.
6. Subscriptions and purchases
The App is currently free.
7. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of measurements, or uninterrupted availability. Sensor-derived numbers are estimates (see Section 1).
8. Limitation of liability
To the maximum extent permitted by law, GymKin will not be liable for indirect, incidental, special, consequential, or punitive damages, or for personal injury arising from your training decisions, and our total liability for any claim relating to the App will not exceed the greater of USD 50 or the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow these limitations; they apply to the fullest extent permitted.
9. Termination
You may stop using the App at any time. We may suspend or terminate accounts that violate these Terms or where required by law. Sections that by their nature should survive (your content license for already-shared items, disclaimers, liability limits) survive termination.
10. Changes
We may update these Terms; material changes will be announced in the App or by email. Continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the State of Colorado, USA, excluding conflict-of-law rules.
